Terms of Service
These Terms of Service (“Terms”) govern your access to and use of EasyPusher’s website (easypusher.com), web application (app.easypusher.com), WordPress plugin, APIs, and related services (collectively, the “Services”), operated by EasyPusher (“we,” “us,” or “our”).
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least the age of majority in your jurisdiction and able to form a binding contract. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
2. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
3. The Services
EasyPusher provides tools for web push notifications, including the EasyPusher WordPress plugin used together with our hosted service at app.easypusher.com. The plugin is not a standalone replacement for that infrastructure: you need an account and API key so we can provision VAPID keys, authenticate your site, sync aggregate analytics, enforce plan limits, and deliver campaigns to push endpoints stored on your WordPress site, as described in our Privacy Policy and the plugin’s readme.txt (including the External Service disclosure for WordPress.org).
Some features require an active subscription or API credentials as described on our pricing page. We may modify, suspend, or discontinue parts of the Services with reasonable notice where practicable.
4. Acceptable use
You agree not to:
- Violate applicable laws or third-party rights
- Send spam, deceptive, or malicious notifications
- Attempt to gain unauthorized access to our systems or other users’ data
- Reverse engineer, scrape, or overload the Services except as permitted by law
- Use the Services to distribute malware or harass others
You are responsible for obtaining valid consent from end users where required for push notifications and for complying with privacy laws applicable to your use case.
5. Customer data
Data you submit to the Services is governed by our Privacy Policy. Subscriber data collected via the WordPress plugin may reside on your server; data processed through our hosted application is processed as described in the Privacy Policy.
6. Fees and payment
Paid plans are billed according to the terms presented at checkout. Fees are non-refundable except as required by law or as we specify in writing. We may change prices with advance notice.
7. Intellectual property
The Services, including software, branding, and documentation, are owned by EasyPusher or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the hosted Services (dashboard, APIs, and infrastructure). The EasyPusher WordPress plugin is licensed under the GNU General Public License v2 (or later) as stated in the plugin files; your use of the plugin does not override these Terms for the hosted service, accounts, or paid plans.
8. Third-party services
Beyond our own properties (easypusher.com, app.easypusher.com), the Services may rely on subprocessors such as payment processors, cloud hosting, email providers, and (on the marketing site) analytics tools such as Google Analytics. Your use of those components may be subject to their respective terms and privacy policies.
9. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYPUSHER AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
11. Indemnity
You will defend and indemnify EasyPusher against claims arising from your use of the Services, your content, or your violation of these Terms or applicable law.
12. Termination
We may suspend or terminate your access for breach of these Terms or for operational reasons. You may stop using the Services at any time. Provisions that by their nature should survive will survive termination.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which EasyPusher operates, without regard to conflict-of-law principles, except where mandatory consumer protections apply in your country.
14. Changes
We may update these Terms by posting a revised version on this page and updating the “Last updated” date. Continued use after changes constitutes acceptance of the revised Terms.
